These Terms and Conditions apply to the Bayleys Real Estate Limited (Bayleys) Party Starter (Promotion) and prize (Party Starter Kit). If you enter into the Promotion, you will be deemed to agree to and be bound by these Terms and Conditions.

1. How to Enter
1.1 The following information on how to enter the Promotion forms part of the conditions of entry.
1.2 To enter, you must satisfy the following conditions:
(a) Register for Party Starter campaign.
(b) Agree to one of our agents contacting you for a no-obligation discussion regarding property.
(c) You can only enter once for the Party Starter campaign.

2. Eligibility
2.1 The following eligibility criteria apply:
(a) The promotion is open only to persons in Gisborne/Mahia. The promotion is not eligible for commercial properties, properties outside of Gisborne/Mahia, or lease/rental listings.
(b) Registrations received outside of the Promotional Period will not be eligible for entry.
(c) The promotion is open to New Zealand residents aged 18 years or over.
(d) Staff and families of Bayleys and its subsidiaries, and anyone associated with the promotion are not eligible to enter. Bayleys reserves the right to verify the eligibility of all participants.

3. The Prize
3.1 There is one prize valued at over $1,000 which includes a portable Weber BBQ and utensils, vintage cooler box, JBL Bluetooth speaker, picnic blanket and 2 x $100 Prezzy cards.
3.2 The Prize cannot be exchanged for cash.
3.3 All costs and expenses, maintenance, will be your responsibility following the date the Prize is handed to you.

4. Accepting the Prize
4.1 The Prize winner will be drawn at random by Bayleys General Manager Stu Potter following the Auction event of Friday 6 December at the Bayleys office (10 Reads Quay, Gisborne).
4.2 If you are drawn as the Prize winner, Bayleys will attempt to notify you by phone at the contact telephone number provided on the registration.
If Bayleys, having used reasonable efforts, is unable to contact you prior to 5.00pm on 13 December 2024, then the prize is forfeited and Bayleys will conduct further draw(s) until the Prize is validly accepted. Bayleys’ decision is final and no correspondence will be entered into.
4.3 You must confirm acceptance of the Prize within 24 hours of being notified.
4.4 The Prize does not include delivery. You will be required to pick up the Prize from Bayleys Gisborne office (10 Reads Quay) no later than 18 December. You must bring photo identification with you at the time you pick up the Prize. Bayleys reserves the right to verify your identity prior to releasing the Prize to you.
4.5 If you do not confirm acceptance of the Prize within the stipulated time frame, expressly reject the Prize or fail to pick it up in accordance with paragraph 4.4, Bayleys will, in its sole discretion, deal with the unaccepted or unclaimed Prize as it deems fit.
4.6 By accepting the Prize, you will be deemed to have consented to, participate and co-operate in (at Bayleys reasonable request) media requests relating to the Prize, including but not limited to, being photographed and having your first name, photo and quotes published in any media owned by Bayleys, without any payment, fee or compensation whatsoever.
4.7 The Prize is not negotiable, transferable, exchangeable or redeemable for cash, credit of any kind, either in part or in full.

5. Miscellaneous
5.1 Bayleys reserves the right to disqualify you if it considers, in its sole discretion, that you have breached any of these Terms and Conditions, acts in a fraudulent, dishonest or disruptive manner, or otherwise than in accordance with the spirit and intent of this promotion or is involved in any way in interfering or tampering with the conduct of this promotion.
5.2 By entering this promotion or accepting a Prize, to the maximum extent permitted by law, you agree to indemnify, release and hold harmless Bayleys and any of its employees, agents or contractors against any and all liability, losses, damages (including special, indirect and consequential damages), claims, costs and expenses arising from or incurred, directly or indirectly, as a result of your entry into the promotion and acceptance, possession, use or misuse of the Prize.
5.3 Bayleys reserves the right to amend these Terms and Conditions, either wholly or in part, including the right to cancel this promotion, in such manner as it deems fit, without prior notice or reason, and without liability to you.
5.4 In the event of any inconsistency between these Terms and Conditions and any brochures, marketing or promotional materials relating to the promotion, these Terms and Conditions will prevail.

6. Privacy Policy
6.1 Bayleys will comply with its obligations under the Privacy Act 1993.
6.2 By entering the promotion, you agree to receive further information regarding Bayleys about its products, services, and other offerings (including by electronic message, including email and text message) using the contact details provided by you.
6.3 Bayleys may collect, use and disclose your personal information (as that term is defined under the Privacy Act 2020) for the following purposes:
(a) to communicate with you for the purposes related to the promotion;
(b) to send you information, marketing and promotional material from Bayleys via email or other electronic means from time to time, provided that any electronic messages will contain an unsubscribe facility in accordance with section 11 of the Unsolicited Electronic Messages Act 2007; and
(c) for publicity (whether to promote the Giveaway or otherwise) and for other matters for which you have provided Bayleys with consent, without further notification, remuneration or compensation.

7. Digital Promotion
7.1 The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, LinkedIn, X or any other social media platform on which Bayleys advertises the Giveaway.
7.2 You will fully release and hold Meta harmless from liability in relation to this Promotion or the Prize.
